1. Agreement to Terms

By purchasing, downloading, or using ScoreKeeper ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. License Grant

Upon purchase, EMSERO grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on iOS devices that you own or control, strictly in accordance with these Terms and the App Store Terms of Service.

3. Restrictions

You may not:

  • Copy, modify, or create derivative works of the App
  • Reverse engineer, decompile, or disassemble the App
  • Rent, lease, lend, sell, redistribute, or sublicense the App
  • Remove or alter any proprietary notices on the App
  • Use the App for any illegal or unauthorized purpose

4. Ownership

The App and all intellectual property rights therein are and shall remain the property of EMSERO. These Terms do not grant you any rights to trademarks, service marks, or logos.

5. User Data

Local Data

All game data is stored locally on your device and in your personal iCloud account (if enabled). You retain all rights to your data.

Collaborative Features (Optional)

If you enable collaboration features, certain game data (game names, player names, scores) will be transmitted to our servers to enable real-time synchronization. See our Privacy Policy for details.

Nearby Discovery (Optional)

If you enable nearby player discovery, your device name and an anonymous identifier are broadcast locally via Bluetooth/WiFi. No data is sent to servers. See our Privacy Policy for details.

6. Purchases and Payments

Pricing

The App is available for a one-time purchase through the Apple App Store. Pricing is set by Apple and may vary by region.

Payment Processing

All payments are processed by Apple. EMSERO does not collect or store your payment information.

Refunds

All refund requests must be directed to Apple according to their standard refund policies. We do not process refunds directly. To request a refund, contact Apple Support or visit reportaproblem.apple.com.

EU Consumer Rights

EU consumers have the right to withdraw from digital content purchases within 14 days. However, by downloading and using the App, you acknowledge that you forfeit this right as the content is immediately accessible. Refund requests should still be directed to Apple.

7. Disclaimers

"As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No Guarantee

We do not warrant that:

  • The App will meet your requirements
  • The App will be uninterrupted, timely, secure, or error-free
  • Any errors in the App will be corrected
  • The App will be compatible with future iOS versions

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMSERO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the App
  • Any unauthorized access to or use of your data
  • Any bugs, viruses, or other harmful code in the App
  • Any content or conduct of third parties using collaborative features
  • Any other matter relating to the App

IN NO EVENT SHALL EMSERO'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP.

9. Indemnification

You agree to indemnify and hold harmless EMSERO and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party

10. Changes to the App

We reserve the right to:

  • Modify or discontinue the App at any time
  • Update the App to fix bugs or add features
  • Change these Terms at any time

We will notify users of significant changes through the App or via email. Continued use after changes constitutes acceptance.

11. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Material changes will be notified via the App or email. Your continued use of the App after changes constitutes acceptance of the new Terms.

12. Termination

By You

You may stop using the App at any time by deleting it from your devices.

By Us

We reserve the right to suspend or terminate your access if you violate these Terms, without refund.

Effect of Termination

Upon termination, you must cease all use and delete all copies of the App. Sections that by their nature should survive termination (Ownership, Disclaimers, Limitation of Liability, Indemnification) will remain in effect.

13. Third-Party Services

Apple App Store

Your use of the App is also subject to Apple's App Store Terms of Service. In case of conflict between these Terms and Apple's terms, Apple's terms prevail regarding your use of the App Store.

iCloud (Optional)

If you use iCloud sync, Apple's iCloud Terms of Service apply to that data.

14. Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

15. Export Control

You agree to comply with all applicable export and import laws and regulations. You shall not export or re-export the App to countries, persons, or entities prohibited by applicable laws.

16. Governing Law and Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or the App shall be resolved through:

  1. Informal Resolution: Contact us at support@emsero.com to attempt resolution
  2. Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration
  3. Small Claims Court: You may pursue claims in small claims court if they qualify

Class Action Waiver

You agree to resolve disputes on an individual basis only, not as part of a class action or representative proceeding.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and EMSERO regarding the App and supersede all prior agreements and understandings.

19. No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
