Terms of Use

These Terms of Use ("Terms") govern your use of the ThrowZone mobile application ("the App"). By installing, accessing, or subscribing to the App you agree to these Terms. If you do not agree, do not use the App.

1. Who the App is for

ThrowZone is a business-to-business (B2B) application licensed to commercial axe-throwing and dart-throwing venues ("Venues") for use on venue-owned tablets in a kiosk configuration. It is not intended for general consumer use.

One subscription covers one venue site. Operators of multiple sites must obtain a separate subscription per site, or contact support@emsero.com for a chain license under §8. Sharing a single Apple ID's subscription across multiple physical venues is a breach of these Terms.

2. Subscription plans and pricing

The Staff Dashboard features of the App are licensed on an auto-renewing subscription basis through Apple's App Store. Each plan covers one venue site at the lane capacity stated:

• Starter — up to 4 lanes. Monthly $39.00 USD or Annual $390.00 USD.
• Standard — up to 8 lanes. Monthly $69.00 USD or Annual $690.00 USD.
• Pro — up to 12 lanes. Monthly $99.00 USD or Annual $990.00 USD.
• Unlimited — no lane cap (single venue site). Monthly $199.00 USD or Annual $1,990.00 USD.

All plans are within a single Apple subscription group; Apple handles plan changes (tier or billing period) as level changes with proration. Prices are subject to change; existing subscribers will receive advance notice of any price change through Apple's subscription-change notification.

Venues that need more than 12 lanes but do not want the Unlimited plan, and operators of multi-site chains, may request a direct invoice license under §8.

3. Free trial

First-time subscribers to the Starter plan (monthly or annual) receive a 14-day free trial. If you do not cancel before the trial ends, your subscription automatically converts to the paid plan you selected, and your Apple ID is charged at the price listed above. Trials are available only once per Apple ID. Trials are not offered on Standard, Pro, or Unlimited.

4. Auto-renewal

Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period. Your Apple ID is charged the applicable subscription fee on renewal.

You can manage or cancel your subscription at any time through your iOS device:
Settings → [Your Apple ID] → Subscriptions → ThrowZone.

Canceling a subscription stops future renewals; you retain access for the remainder of the current billing period.

5. Refunds

Refund requests for App Store purchases are handled by Apple and are at Apple's sole discretion. EMSERO LLC does not process App Store refunds directly. To request a refund, visit reportaproblem.apple.com.

6. Lane slot entitlement

Each paid subscription includes the number of lane tablet connections stated in Section 2. The App enforces this quota locally on the staff-dashboard tablet. Exceeding the licensed lane count on a venue's network is a breach of these Terms. The quota is bound to a single venue site (see §1); using the same subscription to staff lanes at multiple physical venues is also a breach.

7. Offline operation and data handling

The App operates entirely on the venue's local network. ThrowZone does not receive venue data — player names, scores, photos, or session history — at EMSERO servers. See the Privacy Policy for details.

8. Direct invoice and chain licensing

Single-site venues that need a lane capacity not available through the App Store plans (between 13 and any custom number), and operators of multi-site chains, may request a direct invoice license in place of App Store billing. Contact support@emsero.com for pricing and onboarding.

9. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or modify the App except as permitted by law.
• Circumvent the lane-slot quota or licensing checks.
• Use the App to facilitate real-money wagering or cash prizes.
• Distribute, sublicense, or resell the App or access to the App.

10. Disclaimer

The App is provided "as is." Axe throwing and dart throwing involve inherent physical risk. Venues are solely responsible for staff training, safety briefings, and compliance with applicable law and insurance requirements. EMSERO LLC makes no warranty that the App is suitable for any particular venue or safety framework.

11. Limitation of liability

To the fullest extent permitted by law, EMSERO LLC's aggregate liability arising out of or relating to these Terms or the App is limited to the amount the subscribing Venue paid EMSERO LLC in the twelve (12) months preceding the event giving rise to the claim.

12. Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Travis County, Texas, and both parties consent to the personal jurisdiction of those courts.

13. Changes to these Terms

EMSERO LLC may update these Terms from time to time. Material changes will be announced at least 30 days in advance through in-app notice or email to the venue's billing contact. Continued use of the App after the effective date constitutes acceptance of the updated Terms.
